Liability of associations and its directors: What you need to know and which insurance contracts do you need to have  
 

Insuring the various risks to which an association may be exposed in its activities is no easy task. This is all truer given that the specific situation of associations is not always well understood by brokers and insurers. Our speakers will therefore outline the principles in this area, illustrated with practical examples.

Hélène Cambresier, Counsel at the law firm DWMC, will begin by briefly reviewing the applicable principles of liability, with a particular focus on the regime of non-contractual liability, which has undergone significant changes since January 1, 2025. Hélène will attempt to identify certain guidelines after 11 months of application of the law. She will illustrate her presentation with concrete examples of contractual clauses designed to protect the liability of associations and their directors. She will conclude her presentation with best practices for the organization of events.

Christelle Bastogne, Senior Broker at VanBreda, will then take over to outline the general principles of liability insurance for associations and their directors, with a particular focus on the risks specific to organization of events. She will illustrate her presentation with concrete examples, derived from 8 years of experience at Vanbreda risk &benefits and 15 years in the insurance business servicing her clients.
